Standard License (Non-Exclusive)
If you’re an independent artist looking to purchase beats, understanding the Standard License Agreement is crucial. This license gives you the legal rights to use a beat in your music without exclusive ownership. Below, we’ll break down everything you need to know about how this agreement works, what you can and can’t do, and how to maximize your investment in your music career.
What Is a Standard License?
A Standard License (Non-Exclusive) allows an artist to use an instrumental (beat) to create a new song while the producer retains ownership of the beat. This means other artists can also license the same beat.
✅ You get the right to use the beat in your music.
❌ You don’t own the beat exclusively (other artists can use it too).
What You Get with Your License
Once you purchase a beat under the Standard License, you receive:
- A high-quality audio file of the beat.
- Legal permission to use the beat in your song for a limited time and purpose.
- The ability to sell and distribute your new song (under the allowed conditions).
Key Terms & Conditions of Your License
1. Payment & License Validity
- The License Fee is a one-time payment. Once you pay, you receive the rights to use the beat under this agreement.
- Your license is valid for 4 years from the date of purchase. (When term ends you must purchase license again, if available)
- If you don’t pay the license fee, your rights are not valid.
2. How You Can Use the Beat
With this license, you can:
✅ Modify the Beat – Change the arrangement, tempo, pitch, or structure to fit your song.
✅ Create a New Song – Record vocals over the beat and make an original track.
✅ Distribute Your Song – Sell up to 7500 copies (digital/physical).
✅ Stream Your Song Online – You are allowed up to 115000 audio streams (e.g., Spotify, Apple Music).
✅ Use It in a Music Video – Allowed 1 monetized video streams (YouTube, Vevo, etc.).
✅ Perform the Song Live – You can perform your song for 10 paid performances.
✅ Radio Play – Allowed on up to 0 radio stations.
3. What You CAN’T Do with the Beat
To keep things fair and within legal boundaries, there are restrictions:
❌ You cannot resell or redistribute the beat as-is.
❌ You cannot transfer or sublicense the license to someone else.
❌ You cannot claim full ownership of the beat.
❌ You cannot use the beat for TV, film, or commercials.
❌ You cannot register the beat (or your song using it) in a Content ID system (e.g., YouTube Content ID, TuneCore, CD Baby).
If you violate these terms, your license may be revoked without compensation.
Understanding Ownership & Royalties
- You own 100% of the lyrics and vocals you record.
- The producer retains full ownership of the beat.
- Publishing split: The producer owns 50% of the publishing rights for the composition.
- You must credit the producer as: “Produced by AR$ NOVA” on all releases.
If you register your song with a Performing Rights Organization (PRO) (e.g., ASCAP, BMI), you must include the producer’s name for 50% ownership of the composition.
What Happens If You Break the Agreement?
If you break the terms of the agreement (e.g., exceeding distribution limits or misusing the beat), the producer can:
- Revoke your license immediately – meaning you can no longer use the song.
- Take legal action – including financial penalties or removing your song from streaming platforms.
- Seek damages – if you make unauthorized sales or misuse the beat.
Final Thoughts: Should You Get a Standard License?
A Standard License (Non-Exclusive) is a great choice if you’re an independent artist looking for an affordable way to release music legally. It gives you:
✔️ Legal security – No copyright issues.
✔️ Flexibility – Ability to monetize and perform your song.
✔️ Cost-effectiveness – A lower price compared to an exclusive license.
However, if you want full ownership, unlimited rights, or plan to use the beat in major commercial projects (TV, film, ads), then an Exclusive License may be the better option.
Exclusive Rights
Exclusive Beat License Agreement: Everything You Need to Know Before Buying
If you’re an artist looking to secure full rights to a beat, purchasing an Exclusive License is the best way to ensure that your song is 100% yours. Unlike non-exclusive licenses, where multiple artists can use the same beat, an exclusive license grants you sole ownership of the beat for your creative and commercial use.
In this guide, we’ll break down the Exclusive Beat License Agreement in simple terms, so you know exactly what you’re getting and how to make the most of your investment.
What Is an Exclusive License?
An Exclusive License means that once you purchase a beat:
✅ You get exclusive rights—no one else can use the beat.
✅ You can modify the beat to fit your song.
✅ You can sell, distribute, and monetize your song with no expiration date.
✅ You gain full ownership of the master recording of your song.
✅ You can register your song with PROs (Performing Rights Organizations) like ASCAP, BMI, or SESAC and earn royalties.
However, the producer still retains partial ownership of the composition, meaning they share in publishing and mechanical royalties.
Key Terms & Conditions of Your License
1. Payment & Delivery
- The License Fee is a one-time payment—once you pay, the beat is officially yours under the agreement.
- The beat will be delivered in high-quality audio format via email or downloadable from your account.
2. No Expiration Date
- Unlike non-exclusive licenses that expire after a few years, this Exclusive License lasts forever.
- You can continue to sell, stream, and perform your song without restrictions.
3. How You Can Use the Beat
With an Exclusive License, you get unlimited rights to:
✅ Modify the Beat – Adjust the arrangement, length, tempo, and pitch.
✅ Create Unlimited Songs – Use the beat to create as many songs as you want.
✅ Distribute and Sell Your Song – No limits on the number of physical or digital sales.
✅ Unlimited Streaming & Monetization – Earn money from your music on Spotify, Apple Music, YouTube, etc.
✅ Perform Live – Perform your song at concerts, festivals, radio stations, and clubs.
✅ Sync Licensing – Use your song in TV, films, YouTube videos, and commercials (with proper credit and revenue splits).
4. What You CAN’T Do with the Beat
Even with full ownership of the master recording, there are some restrictions:
❌ You cannot resell or redistribute the original beat.
❌ You cannot transfer or sublicense the license to someone else.
❌ You cannot register the original beat as your own work.
❌ You cannot register the beat (before adding vocals) to a content ID system (YouTube, TuneCore, CD Baby, etc.).
Ownership & Royalty Splits
When you purchase an Exclusive License, ownership of the beat is divided as follows:
✅ You own 100% of the master recording (your song with vocals).
✅ You own 100% of the lyrics and original melodies you create.
✅ The producer retains 50% of the publishing rights (since they created the instrumental).
Royalties Breakdown
When your song generates revenue, payments are split as follows:
- Mechanical Royalties (Streaming, Sales, DSPs like DistroKid & TuneCore)
- You keep 90%
- Producer receives 10%
- Performance Royalties (ASCAP, BMI, SESAC, etc.)
- Songwriter Royalties – 50% Artist / 50% Producer
- Publishing Royalties – 50% Artist or Publishing Company / 50% Producer
📌 Important: If you register your song with a PRO, you must include the producer’s name for their 50% share of the composition rights.
What Happens If You Break the Agreement?
If you violate any terms of the agreement, the producer has the right to:
- Revoke your license – meaning you lose all rights to use the beat.
- Take legal action – including financial penalties or removal of your song from all platforms.
- Seek damages – if you make unauthorized sales or misuse the beat.
Final Thoughts: Should You Buy an Exclusive License?
If you’re an artist who wants full creative control, unlimited usage rights, and exclusive ownership, an Exclusive License is the best option. It’s perfect for:
✔️ Serious artists who want to invest in their career.
✔️ Labels & managers who need full control over their artist’s music.
✔️ Artists looking to release hit singles, albums, or sync deals.
While exclusive licenses are more expensive than non-exclusive licenses, the long-term benefits far outweigh the cost—especially if your song becomes a hit!
